Welcome to Hearthly! By using our mobile application, you agree to these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By downloading, installing, or using the Hearthly app (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Hearthly is a home cleaning companion app designed to help you maintain a tidy home through gentle, ADHD-friendly task management. The app provides:
- Personalized cleaning task recommendations
- Task scheduling based on your weekly time budget
- Progress tracking with streaks and virtual garden
- Supply inventory management
- Optional premium features through subscription
3. User Accounts
You may be required to create an account to use certain features of the Service. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Subscriptions and Payments
Hearthly offers both free and premium subscription tiers. If you purchase a subscription:
- Billing: Subscriptions are billed through Apple's App Store. Your App Store account will be charged at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation: You can cancel your subscription through your App Store account settings. No refunds will be provided for partial billing periods.
- Price Changes: We may change subscription prices. You will be notified in advance of any price changes.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble the app
- Use automated means to access the Service without permission
- Share your account with others or allow multiple users on one account
6. Intellectual Property
The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software), is owned by Hearthly and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Hearthly is a task management tool and does not guarantee any specific cleaning results. You are responsible for your own cleaning decisions and outcomes.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTHLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless Hearthly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Effective Date” at the top of these Terms. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
